Copyright and Trademark

I contacted HBO (copyrightviolations@hbo.com), the holder of the television rights to True Blood, ACE Books (penguin.subrights@us.penguingroup.com), the publisher of the Sookie Stackhouse novels,and Joshua Bilmes (joshua@awfulagent.com), the agent who handles licensing for Charlaine Harris, the author of the True Blood books in regards to the recall of "Sookie", the pink sold in the True Blood Collection this year.

I included a brief outline of the situation, and links to the product and recall list. I also detailed that should the link I provided to the product not work due to it's removal that I also had screenshots to provide upon request.

Before I could even finish publishing this post I received an email back from Mr. Bilmes, who has already contacted Steve Sass, the head of HBO's Legal Department.

  1. When she started pumping out all these collections the first thing I thought of was "er.. copyright infrigement?". If you look through her album of "custom collections" there are SEVERAL others that I'm sure she did not get permission to make [Gone With The Wind, Sanrio, Twilight, etc]. She also has three seperate Harry Potter collections, each in their own album.

  2. Blu-Thanks for the heads up on where to look. I will take a look and if any of the custom collections has pinks in them I will be contacting their respective copyright holders. Looks like I've got a long night ahead of me. :-)

The Sanrio collection definitely does [I believe the pigment is named after Hello Kitty] and you can see it here: http://www.facebook.com/#!/photo.php?fbid=470600999769&set=a.459703219769.250655.85929629769 , the other ones did not contain any pinks. However I'm sure a lot of those franchises, especially HP and Twilight, would be interested to know these collections were being sold without permission..

  5. Blu-I made it through the entire album finally. I am posting about Sanrio shortly.

    As for the other Copyright and Trademark issues I am limiting myself to those with recalled products, as I believe that they have a right to let their customers know that this unsafe product was not licensed.

    I have been accused via email of attempting to shut GS down. I believe that pursuing all Copyright/Trademark issues would lend credence to that, when really all I'm trying to do is warn people and hopefully get a refund. My stance on that may change in the future, and I have already been sent screenshots of some of the alleged copyright infringement should I decide to pursue it. I need to get the rest just to be sure.

  7. What about Disney? Correct me if I'm wrong but wasn't there a Twisted Princess collection in which she named the colors after Disney Princesses and that had pinks in it. Did she not also make a Tim Burton collection and aren't a few of the colors on the recall list? (I remember Mad Hatter for sure)

  9. Oh and Oompa Loompa is on the list of pigments as well that contain soap dyes so that's another tradmark. Seuss as well.

  10. Annony-Oh my. I had no idea there were so many. I certainly have my work cut out for me tonight. Luckily, I've sent so many copyright messages today I just have a template that I change the links in.

    I have already contacted the Seuss copyright holder, and will be contacting the publisher as well since that has to be in writing.

  11. I didn't want to overwhelm you but figured those would be worth pointing out as well. She might have covered her rear naming the princess collection Twisted Princess but I do know the individual colors were named after the actual princesses. I believe Aurora was the one that was pink. There was also a Wizard of Oz collection in which there was a pink, Glenda.
